1. Scope and contracting party

Your contracting party is:

These terms apply to all orders placed on this website and to the use of the meme generator. They apply to consumers and businesses. Where a rule applies only to consumers, we say so. Different terms of the customer do not apply. The contract language is English.

You must be at least 16 years old to order or create an account. [TODO: confirm minimum age]

2. The products

Quick Dance (€9)

• You choose a pre-made dance clip from our library.
• You enter the recipient’s name (up to 20 characters) and an optional message (up to 60 characters).
• The video is rendered automatically and usually delivered by email within minutes.
• The video carries a small magnusbrick watermark.

Custom Dance (€49)

• You upload a reference video (MP4 or MOV, up to 60 seconds, up to 200 MB). Magnus recreates the movement. The person in your video never appears in the result.
• You choose a prop, optional sign text (up to 40 characters) and an optional note (up to 300 characters).
• The video is made by hand, is up to 20 seconds long, has no watermark, and is delivered within 72 hours.

Videos contain no copyrighted music. Some videos include a royalty-free track that you may share together with the video. The descriptions on the order page apply. Small differences in timing and style are part of how the videos are made and are not a defect.

3. AI character notice

Magnus Brick is an AI-generated character. He is not a real person. He is created with AI tools. Every video and meme carries an “AI character” tag so viewers know the content is AI-generated (Art. 50 EU AI Act). You must not remove or hide this tag.

4. Ordering and contract formation

1. Our products on this website are not a binding offer. They are an invitation to order.
2. You choose a product, enter the details and your email address, and review your order. You can correct any input with the “Back” button before paying.
3. You accept these terms and the privacy policy, and give your express consent to immediate delivery (see section 10).
4. By clicking “Pay and assign Magnus” you are taken to our payment provider Stripe and submit a binding order.
5. The contract is concluded when your payment succeeds and we send you the confirmation email. The confirmation email contains the order details, these terms and your consent to immediate delivery.

We keep the order details. You can view the current terms on this page at any time.

5. Prices

All prices are in euros and include VAT. VAT is calculated by Stripe Tax based on your country. There are no shipping costs.

6. Payment

Payment is made in advance through Stripe. The available payment methods are shown at checkout. Stripe’s own terms apply to the payment itself. We start work only after the payment has succeeded.

7. Delivery and download

• We deliver by email with a download link. There is no physical delivery.
• Quick Dance: usually within minutes. Custom Dance: within 72 hours. If an order is reviewed, it can take a little longer. We will tell you by email.
• The download link works for 30 days. Please save your video. After that, the link expires and we delete the file (see the privacy policy).
• Please check that your email address is correct. If the email does not arrive, check your spam folder and write to us at support@car-artistry.com.

8. Your content and responsibility

You are responsible for the names, messages, sign texts, notes and reference videos you send us (“your content”). You must not send content that:

• contains threats or harassment;
• is sexual;
• expresses hate against anyone;
• impersonates a real person;
• is meant to hurt someone;
• infringes the rights of others, such as copyright, personality or image rights.

For reference videos, you confirm: “I own this video or have permission to use it.” This includes permission from every person shown in the video for it to be used for this purpose. We use only the movement.

You grant us a non-exclusive right to use your content only to make and deliver your video, for the periods stated in the privacy policy.

If a third party makes a claim against us because your content infringes their rights, you will indemnify us against that claim and reasonable legal costs, to the extent permitted by law and only if you are at fault.

9. Our right to decline orders

Texts are checked against a list of blocked words. Flagged orders are reviewed by a person on our team. We may decline orders that break section 8, or that we cannot make for technical reasons (for example, a reference video in which the dance cannot be recognised). If we decline an order, the contract is cancelled and we refund the full amount to your original payment method.

10. Right of withdrawal

If you are a consumer, you have the following right of withdrawal.

Withdrawal information

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Lolip Ltd., Kalina Malina 24, 1111 Sofia, Bulgaria, email: support@car-artistry.com, phone: +43 676 5530594) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Early expiry of the right of withdrawal

Your videos are digital content that is not supplied on a tangible medium. Your right of withdrawal expires once we have begun delivery, if:

1. you expressly agreed that we begin delivery before the end of the withdrawal period;
2. you acknowledged that you thereby lose your right of withdrawal once delivery has begun; and
3. we confirmed the contract, including your consent and acknowledgement, in the confirmation email.

(Art. 16(m) Consumer Rights Directive 2011/83/EU and the Bulgarian Consumer Protection Act, Закон за защита на потребителите.) At checkout you give this consent by ticking the box: “I expressly agree that delivery of the digital content starts immediately after payment. I understand that I lose my right of withdrawal once delivery has begun.”

For a Quick Dance, delivery begins right after payment, so the right of withdrawal usually expires within minutes. For a Custom Dance, if you withdraw before we have delivered the video, we refund you in full. [TODO: have a lawyer confirm how withdrawal applies to Custom Dance]

11. Warranty

The statutory warranty rights apply. For consumers, the rules on digital content in Directive (EU) 2019/770 apply, as implemented in Bulgaria by the Act on the Supply of Digital Content and Digital Services and the Sale of Goods (Закон за предоставянето на цифрово съдържание и цифрови услуги и за продажбата на стоки). If your video is defective, for example it does not play, shows the wrong name or does not match your order, write to us at support@car-artistry.com. We will fix it or make a new one. If we cannot, you may ask for a price reduction or end the contract and get your money back.

12. Liability

• We are liable without limitation for damage caused intentionally or through gross negligence.
• We are liable without limitation for personal injury (death, injury to body or health).
• In all other cases, our liability for slight negligence is excluded, to the extent permitted by law.
• Liability under the Product Liability Act (PHG) is unaffected.
• Mandatory consumer protection law, in particular the Bulgarian Consumer Protection Act and the law of the country where you live, remains unaffected.

13. Using your video

Once you have paid, you receive a non-exclusive, non-transferable, unlimited-in-time right to use the video for personal, non-commercial purposes. You may:

• send it to the recipient and to friends and family;
• post it on your social media accounts, for example TikTok or Instagram;
• add music in apps such as TikTok or Instagram, where the app licenses that music.

You may not:

• remove or hide the “AI character” tag or the watermark;
• use the video to impersonate anyone, or to mislead people into thinking Magnus is a real person;
• use the video for political advertising or for commercial advertising without our prior written permission;
• sell or license the video to others.

The Magnus Brick character, the duckling, the name and the brand remain ours. You receive no rights to them beyond this section.

14. Free meme generator

• The meme generator is free. Downloading requires a free account. Each person gets 3 free downloads after verifying their email address.
• One account per person. Creating several accounts, using temporary email addresses or automating downloads to get more free downloads is not allowed.
• The content rules in section 8 apply to meme text as well. Text with blocked words cannot be downloaded.
• You may use memes for personal purposes and share them on social media. The watermark and the “AI character” tag must remain intact. Commercial use is not allowed.
• We may block accounts that break these rules.
• The free service has no guaranteed availability. We may change or end it at any time. Your use of it does not depend on agreeing to marketing emails.

15. Accounts and deletion

You can delete your account at any time by writing to support@car-artistry.com. [TODO: add in-app deletion if available] Unused free downloads lapse when the account is deleted. Orders and invoices we must keep by law are not affected.

16. Governing law and jurisdiction

Bulgarian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-laws rules. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory rules of the country where you live.

If you are a consumer, you can bring proceedings in the courts where you live, and we can only sue you there. For businesses, the courts in Sofia, Bulgaria have exclusive jurisdiction.

17. Final provisions

If any provision of these terms is or becomes invalid, the remaining provisions remain valid. The invalid provision is replaced by the statutory rule.

We may change these terms for future orders. The terms that apply to your order are the ones accepted at checkout and sent with your confirmation email.
